Terms of Service

01Acceptance of Terms

By accessing or downloading the FenixUz Application, you confirm that you have read, understood, and agreed to all provisions of these Terms and our Privacy Policy. The Terms constitute an agreement entered into between VipAds LLC ("Company") and you ("User").

02Definitions

• Services — the FenixUz mobile application, the fenixuz.uz website, and all related functionality.
• Content — any text, image, video, audio, or other information that you send, receive, or publish through the Services.
• Account — your personal profile registered with Telegram and connected through FenixUz.

03Age Restriction

The Services may only be used by persons who are at least 13 years of age. Persons aged between 13 and 17 must use the Services with the consent of a parent or legal guardian. If your country's legislation establishes a higher age threshold (e.g., 16 years under GDPR-K), you must have reached such age.

04Account Registration

FenixUz connects to a Telegram account. The Telegram account is operated by Telegram FZ-LLC, and their Terms of Service shall also be binding upon you.

You hereby represent and warrant the following:

• All information provided is true, current, and complete;
• You shall keep your account and password secure;
• You shall promptly notify us and Telegram of any lost or stolen device;
• You shall not create accounts in the name of another person or engage in resale activities.

05License

The FenixUz source code is made available under the GNU General Public License v2.0+. This means that you have the following rights:

• To use the Application personally for any purpose;
• To study and modify the source code;
• To publish your own forks (subject to GPL terms).

However, the "FenixUz" name, logo, and the publications on the Apple App Store/Google Play consoles are the property of VipAds LLC and are not subject to a separate license.

06User Content

You retain copyright in all Content you create, send, or publish through the Services. However, you hereby grant us (and Telegram FZ-LLC) the right to process such Content to the extent necessary to provide the Services.

You hereby represent and warrant the following:

• The Content does not infringe the rights of any third party;
• The Content does not violate any law;
• The Content does not harass or threaten others.

07Prohibited Conduct

You shall not engage in the following actions through the Services:

• Distributing spam, fraudulent or false messages;
• Causing harm, threatening, or insulting others;
• Promoting child pornography, terrorism, or extremism;
• Infringing copyright or trademark rights;
• Distributing malicious software (viruses, trojans, ransomware);
• Conducting DDoS attacks against the Telegram or FenixUz infrastructure;
• Using automated tools (bots) in violation of the Application's Terms of Use;
• Reverse engineering or circumventing security mechanisms.

08Intellectual Property

The FenixUz brand, design, and materials are owned by VipAds LLC. If you believe that the copyright of another person has been infringed, please notify us under the DMCA. For more details, see the DMCA Policy.

09Free Service

FenixUz does not charge any fees. Telegram Premium features are sold by Telegram and are processed through the Apple/Google payment systems. VipAds LLC does not participate in Premium sales and is not responsible for any refund requests related thereto.

10Modifications to the Service

We reserve the right to modify, suspend, or completely discontinue any part of the Services at any time. Where possible, we will provide 30 days' advance notice of material changes.

11Account Suspension

We reserve the right to restrict or terminate your access to the account in the following circumstances:

• Where you have breached these Terms;
• Where you have engaged in culpable conduct (fraud, attacks);
• Pursuant to a court order or directive of an authorized body;
• Where there exist technical security threats.

Termination shall ordinarily be effected with prior notice, except where immediate action is required.

12Disclaimer of Warranties

The Services are provided "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we hereby disclaim all warranties, whether express or implied, including but not limited to:

• Merchantability;
• Fitness for a particular purpose;
• Non-infringement;
• Uninterrupted, error-free, or secure operation.

No oral or written advice from us shall create any additional warranty.

13Limitation of Liability

To the fullest extent permitted by law, VipAds LLC shall not be liable for the following types of damages:

• Indirect, incidental, punitive, or special damages;
• Loss of profits, revenue, data, or opportunities;
• Any damages arising from the use or inability to use the Services.

Our sole liability, if any, shall be limited to the amount you have paid for the Application (since FenixUz is free of charge — $0).

14Indemnification

You shall defend and indemnify VipAds LLC, its employees, and partners against any claims, demands, court costs, and damages arising from: (i) your breach of the Terms; (ii) your Content; (iii) your violation of any law.

15Force Majeure

We shall not be liable when performance of obligations becomes impossible due to natural disasters, war, terrorism, governmental actions, internet outages, power outages, or other events beyond our control.

16Export Controls

The Application contains strong cryptographic technology. You hereby warrant that you will not export the Application to any country subject to sanctions imposed by the United States, the EU, or your country. You must not be on any export-control restricted list.

17Governing Law and Arbitration

These Terms shall be construed in accordance with the laws of the Republic of Uzbekistan. Any dispute shall first be resolved through good-faith negotiations. If unresolved, the dispute shall be submitted to the competent court in Tashkent City. For European Union consumers, the ODR platform is available: ec.europa.eu/consumers/odr.

18Class Action Waiver

To the extent permitted by law, you hereby waive your right to participate in any class action or representative proceedings. Any dispute shall be resolved on an individual basis only.

19Severability and Entire Agreement

If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect. These Terms together with the Privacy Policy constitute the entire agreement between you and us.

20Modifications and Contact
